Louisiana Adopts NAIC Annuity Regulations

Louisiana becomes the 45th state to adopt the NAIC’s (4) hour annuity training for all licensed producers selling, soliciting or negotiating annuities products.

Louisiana has had an annuities requirement since 2012 but recently updated Regulation 89 Suitability in Annuity Transactions Model Regulation in accordance with the NAIC Suitability in Annuity Transactions Model Regulation as of September 20, 2024. The new training includes:

  • The types of annuities and various classifications of annuities.
  • Identification of the parties to an annuity.
  • A description of how fixed, variable, and indexed annuity contract provisions affect consumers.
  • The application of income taxation of qualified and nonqualified annuities.
  • The primary use of annuities.
  • Appropriate standard of conduct, sales practices, replacement, and disclosure requirements.

Producers who have taken annuities training per the 2010 Suitability rules will need to complete a one-hour course by March 20, 2025 on appropriate sales practices, replacement and disclosure requirements.

New producers or those who have never taken annuities training will need to take the updated NAIC compliant four-hour training.
